Hey Big Brother, leave my levels alone

Sony and Activision Blizzard have confirmed that they are removing user-generated content from the online portions of their games "LittleBigPlanet" and "Guitar Hero World Tour," respectively. The offending levels and songs, the companies say, contain images and sounds from third-party games that the gamers do not have the rights to use.

Gamers in these nascent communities are furious, but the terms of service are clear -- and so is the law.

In an effort to control everything and take away what fans like, these big companies are really hurting themselves.  I'm going to pass on Little Big Planet, just forget it.

I received an email from Sony stating that anything posted on their site is now their property, so I stopped posting.  I can find another forum.

    I don't really understand why there is even an issue to begin with. What do the companies who have had their "rights violated" lose? If anything, they should be happy that people care enough to base their user-generated content on their own game. Not to mention that they get free advertising out of it.

    That is, unless, that Sony is only pulling content based on its competitors' content. In which case I suppose it is semi-justified, but still quite lame. As for Guitar Hero, what I said previously still stands.

      The companies need to first explain why they are pulling the content. Can they -really- be sued for copyright infringement if we design mocks of others' video games? There is no profit to the poster if they do such, and how disimilar is it to showing to friends (or the world via a video or audio stream) your take, say, of the Mario Bros. theme on your ukelele? Can Nintendo sue me if I break out my harmonica, play my own ocarina of time, and let the world hear it while -not- gaining a profit (monetary or otherwise) from it?

      If there is legitimate legal threat, then a clear explanation is due to us, and we will be much less likely to digress. If there is a legitimate legal threat and Sony also advises us on who to contact about creating a formal review on user-generated content and copyright law, then we will let Sony be and vet to the proper authority —or at least threaten to contact the appropriate authority in our forum posts.

        I suppose if you post original works their site you better get a copyright for your songs.  Who is to say someone else won't download it, copy it, submit for copyright and then tell game provider to pull it or pay them?

        Which if people are careful I suppose could be used a nice tool for opening creative community of people who don't other wise have access or the know how to go about creating original works of music legally.

        Activision maybe you should have your legal team work with the upload community and provide a means creative protection for them with an aggreement the original works are theirs and at the same time they provide you with the right to use the original works at no cost to the game community.  If anybody were to reproduce the works for a monitary value the creator could pursue due compensation for their creative and artisitic works.

        Trust me someone has all ready thought of the possibility of plagerizing those works for their own benefit if it is not already in the works somewhere.  Head it off before it gets ugly in the courts.
